1. How Much Does It Cost to Apply for a Trademark With IdeaLegal?

IP Accelerator Pricing for U.S. Filings

We charge a flat fee to file trademark applications for IP Accelerator clients. We charge a flat fee to file trademark applications for IP Accelerator clients on a per-class basis. A one-class use-based trademark application is a $600 IdeaLegal fee + $350 USPTO filing fee ($950 total). Additional classes are a $150 IdeaLegal fee + $350 USPTO filing fee ($500 total for each additional class). There are no added fees for monitoring and reporting on your application. The flat fee includes the following services from IdeaLegal. If your case requires additional work outside this scope of service, additional fees will apply.

  • Preparing and filing a trademark application

  • Reporting your serial number to Amazon

  • Reporting any verification codes required for Brand Registry enrollment

  • Reporting the publication of your application

  • Reporting the registration of your mark and sending you an electronic certificate of registration

Trademark searches are an add-on service that we encourage all of our clients to include, but they are not required. There are two tiers of trademark search:

  • High-level (basic brand search of trademark records at the USPTO): $500

  • Comprehensive (includes search of USPTO trademark records, search of state trademark registries, and unregistered uses found online): $1,800

Additional fees are billed according to your attorney’s hourly rate ($400/hour). The amount of time required will depend on the complexity of your situation. We only charge additional fees for add-on services not included in the IP Accelerator flat rate, and will always obtain your agreement before charging additional fees. Add-on services include the following:

  • Telephone consultations

  • Reporting, researching, and responding to office actions (refused applications)

  • Negotiations or dispute resolution to obtain your registration

  • Starting or settling opposition and cancellation proceedings to obtain your registration

  • Change of information filings (e.g., updating name or address on trademark

    application)

  • Assigning your application or registration to another company

  • Receiving & forwarding your paper trademark certificate

IP Accelerator Pricing for Non-U.S. Filings (sell your product and have brand protections In countries other than the United States of America)

  • We do provide services for filings in jurisdictions outside the U.S.A. We do not offer a flat fee for these filings, though, because the exact services required depend on the jurisdiction. You can usually expect to pay between $1,800 – $2,100 USD for these services.

Do You Offer Bulk Pricing or Discounts?

  • No; our IP Accelerator rates are pre-negotiated with Amazon and are considerably lower than our standard rates. We’re giving you the best deal we can up front!

2. What Is the Process for Joining Brand Registry?

We have worked with more than 1,000 Amazon sellers through IP Accelerator, which has allowed us to make our process quick and efficient. If you check out our reviews from former clients, you’ll see former clients raving about our efficient service. Here’s how it works:

  1. Get informed: We have a full FAQ with detailed legal information you need to know before you start working with us. Reading through this entire FAQ will help you provide us with exactly the information we need, which will make your application process move quickly. We touch on a few of these FAQs here, but not in as much detail as you’ll find in the full FAQ, so make sure to read through the entire thing.

  2. Get in touch: Once you’ve read and understood our FAQ, please get in touch to start your application. This form allows us to gather all the background information we need to provide personalized advice on fees and next steps for your unique situation. All of the advice your attorney provides will be based on the basic information in this questionnaire, so make sure to provide complete, detailed responses. The questionnaire isn’t a contract—filling it out does not obligate you to work with our firm. But we require the basic background information from the questionnaire before you can get input from an attorney.

  3. Check your email: After receiving your questionnaire, an attorney from our IP Accelerator team will reach out to you within 3 business days. Your flat fee for IP accelerator trademark services includes email communications only, so please check your email after filling out the questionnaire so we can get started quickly.

  4. Sign & pay: Once your attorney has received the information they need and you have decided how to proceed, our office will send you an email with a link to e-sign an engagement letter and to pay an invoice for the application or services online. We accept all major credit cards and ACH/wire transfers.

  5. Filing & reporting: When we receive your signed engagement letter and invoice payment, we will aim to file your trademark application within 3 business days. Once the application is filed, we’ll report your trademark application (“serial”) number to Amazon as a first step in your Brand Registry enrollment process.

  6. Self-enroll in Brand Registry: After we report your application number to Amazon, it may take up to 14 days for Amazon’s system to recognize your application number during the self-enrollment process. You should expect anywhere from 3 – 14 days between the time we report your number to Amazon and the time you are able to self-enroll in Brand Registry. You will work directly with Amazon to enroll your brand in Brand Registry. Amazon has said that you will have early access to Brand Registry benefits if you file a trademark application with our firm, but when and how you are ultimately accepted to Amazon’s Brand Registry program is solely under Amazon’s control.

  7. Trademark examination: While you’re working on your Brand Registry enrollment, we will continue to monitor the progress of your trademark application at the USPTO. It can be 6 – 8 months before the trademark office reviews your application and, if approved, an additional 7 – 8 months for the application to register, assuming no problems arose during examination. We will advise you of any important developments relating to your application as they occur.
